These General Terms and Conditions (hereinafter referred to as the “Terms and Conditions” or “Terms”) govern the rights and obligations arising from contracts concluded between the company:

(hereinafter referred to as the “Seller”) and any natural or legal person who places an order via the Seller’s online store available at https://sportec.global (hereinafter referred to as the “Customer”). The Seller operates an online retail store offering sports equipment and related goods.

2. Scope of Application

2.1 These Terms apply to all distance contracts concluded between the Seller and the Customer through the Seller’s online store.

2.2 These Terms apply to Customers located within the European Union (“EU”) as well as Customers located in Turkey and the Gulf Cooperation Council (“GCC”) countries.

2.3 Any deviating or supplementary terms proposed by the Customer shall apply only if expressly agreed to in writing by the Seller.

2.4 The contractual relationship is governed exclusively by these Terms, unless otherwise agreed.

3. Definitions

For the purposes of these Terms:
Consumer means any natural person who, in concluding and performing a contract, is acting outside the scope of their business or professional activity, as defined under Slovak and EU consumer protection law.
Business Customer means a person acting within the scope of their business or professional activity.
Goods means all products offered for sale via the online store.
Contract means a distance sales contract concluded between the Seller and the Customer.

4. Language of the Contract

4.1 The contractual language is English.

4.2 In the event that these Terms are made available in multiple language versions, the English version shall prevail in case of any discrepancies or inconsistencies.

5. Pre‑Contractual Information

5.1 In accordance with applicable Slovak and EU legislation, the Seller provides the Customer, prior to the conclusion of the Contract, with clear and comprehensible information regarding:

  • the main characteristics of the Goods;
  • the identity and contact details of the Seller;
  • the total price of the Goods, including VAT (where applicable), as well as all additional delivery costs;
  • accepted payment methods;
  • delivery conditions and estimated delivery time;
  • the right of withdrawal for EU Consumers;
  • warranty rights and complaint procedures.

5.2 This information is provided on the website and forms an integral part of the Contract.

6. Conclusion of the Contract

6.1 By placing an order through the online store, the Customer submits a binding offer to conclude a Contract for the selected Goods.

6.2 The Contract is concluded when the Seller confirms the order via email.

6.3 Clicking the final order button constitutes the Customer’s acknowledgment that they are incurring a payment obligation.

6.4 Before submitting an order, the Customer may review and correct all entered data using the standard browser and website functions.

6.5 The Seller stores all Contract and order details and makes them available to the Customer via email confirmation and, if applicable, via the Customer account.

6.6 The order confirmation email will include the ordered products, total price including shipping costs, Seller identity, and a link to these Terms.

6.7 The Seller reserves the right to refuse or cancel an order in cases of pricing errors, technical issues, or unavailability of Goods.

7. Prices and Payment Conditions

7.1 All prices are stated in USD.

7.2 For Customers located within the EU, prices include VAT in accordance with applicable EU and Slovak legislation.

7.3 For Customers located in GCC countries, VAT is not applied unless required by local law.

7.4 Shipping costs and any additional fees are displayed separately during the checkout process prior to order confirmation.

7.5 Payment must be made using the payment methods offered during checkout. The Seller shall dispatch the Goods only after receipt of full payment.

8. Delivery and Shipping – General Provisions

8.1 The Seller delivers Goods to all EU Member States, Turkey and selected GCC countries (Saudi Arabia, United Arab Emirates, Qatar, Kuwait, Bahrain, and Oman).

8.2 Delivery times are indicative and may be extended due to circumstances beyond the Seller’s control, including but not limited to customs procedures, force majeure events, or carrier delays.

9. Delivery and Risk Transfer – EU Customers

9.1 For EU Consumers, the risk of damage or loss of the Goods passes to the Consumer at the moment the Goods are physically received by the Consumer or a person designated by the Consumer.

9.2 No customs duties apply to deliveries within the EU.

10. Delivery, Customs and Risk Transfer – GCC Customers

10.1 Goods delivered to GCC countries are shipped internationally from the European Union.

10.2 The courier service may contact the Customer for the purpose of customs clearance. The Customer may either handle customs formalities personally or authorize the courier service by granting a power of attorney.

10.3 The Seller covers standard customs and import tax fees. Any additional, unforeseen, or country‑specific fees shall be borne exclusively by the Customer.

10.4 Unless mandatory consumer protection law provides otherwise, the risk of damage or loss passes to the Customer upon handover of the Goods to the carrier.

11. Right of Withdrawal – EU Consumers Only

11.1 EU Consumers have the right to withdraw from the Contract without giving any reason within fourteen (14) days.

11.2 The withdrawal period expires fourteen (14) days from the day on which the Consumer acquires physical possession of the Goods.

11.3 To exercise the right of withdrawal, the Consumer must notify the Seller of their decision by a clear statement sent by email.

11.4 The Seller shall reimburse all payments received from the Consumer, excluding return shipping costs, within fourteen (14) days from receipt of the returned Goods.

12. Returns and Refunds – EU and GCC Customers

12.1 Returned Goods must be sent to the Seller’s return address: Sportec s.r.o., Napervillska 11, Nitra 94901, Slovak Republic.

12.2 The Customer bears all costs associated with returning the Goods.

12.3 Goods must be returned unused, undamaged, and in their original packaging.

12.4 Refunds are processed within five (5) to seven (7) business days following inspection of the returned Goods.

13. Warranty and Liability

13.1 EU Consumers are entitled to a statutory warranty period of twenty‑four (24) months in accordance with applicable EU and Slovak law.

13.2 The Seller shall not be liable for defects resulting from improper use, normal wear and tear, or failure to follow product instructions.

13.3 The Seller’s liability shall be limited to the maximum extent permitted by applicable law.

14. Data Protection

14.1 The Seller processes personal data in accordance with Regulation (EU) 2016/679 (GDPR).

14.2 Detailed information regarding the processing of personal data is available in the Privacy Policy published on the Seller’s website.

15. Governing Law and Jurisdiction

15.1 These Terms and any contractual relationships shall be governed by the laws of the Slovak Republic.

15.2 EU Consumers shall retain the protection afforded by mandatory consumer protection provisions of the law of their country of residence.

16. Alternative Dispute Resolution

EU Consumers may submit disputes for online resolution via the European Commission’s ODR platform available at https://ec.europa.eu/consumers/odr.

17. Amendments to the Terms

The Seller reserves the right to amend these Terms at any time. Amendments shall apply to orders placed after their publication on the website.

18. Final Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms enter into force on the date of publication.
